1.About these terms

These terms are an agreement between you and [Legal entity name], [Registered address], India (“Shukto”, also called OPC Genie, “we”, “us”). They cover our websites opcgenie.com, opcgenie.in and shuktoai.com and everything on them (the “Service”).

By using the Service you agree to these terms, our Privacy Policy, our Refund Policy and our Cookie Policy. If you don’t agree, please don’t use the Service.

2.What we offer

• For business owners: an AI website builder, website templates, offer and payment pages, and AI Genies that help with sales, content, marketing and customer questions.
• For individuals: Tutor Genie, an AI tutor for children in Class 1–10. More everyday Genies (trips, study abroad, tax and insurance, home and wellbeing) will open later.

3.Your account

• You must be at least 18 years old to create an account. Children may use Tutor Genie only through a parent’s or guardian’s account, with their consent.
• Give us accurate details, and keep your sign-in and your parent PIN private. You are responsible for what happens in your account.
• Tell us straight away if you think someone else has used your account.
• You can stop using the Service at any time. To close your account, write to us.

4.AI Genies and their limits

Our Genies use artificial intelligence. They are helpful, but they can be wrong, out of date or incomplete.

• Not professional advice. Answers about tax, insurance, money, law, study abroad or visas are general information. Check important decisions with a qualified professional such as a chartered accountant, lawyer or licensed adviser, or with the official source.
• Not therapy or medical care. The wellbeing Genie is AI support, not a therapist or doctor. In an emergency in India, call 112. For mental health support, call Tele-MANAS on 14416.
• You decide. You are responsible for how you use what a Genie gives you, including content you publish on your website.

5.Tutor Genie for children

• A parent or legal guardian aged 18 or over must set up Tutor Genie, give consent and choose a PIN.
• Tutor Genie covers school subjects, school tests, board exams and Olympiads up to Class 10. It does not cover JEE, NEET or CUET, and it is not a replacement for teachers.
• It refuses questions that are unsafe or unrelated to learning. After three unsafe attempts the chat stops, and only a parent with the PIN can start a new one.
• Parents can see chat summaries and blocked messages, and are responsible for supervising their child’s use.

6.Prices, the wallet and payments

• Prices are shown on our pricing page and the pricing for individuals, in Indian rupees unless stated otherwise. Any taxes that apply are shown before you pay.
• Paid plans cover the billing period you pay for. A plan is not renewed unless you pay for the next period.
• Some features are paid from your Shukto wallet: AI use is charged by the amount of text processed (tokens) or by the minute, as shown before you use it. Free allowances, such as Tutor Genie’s first 30,000 tokens, come first.
• When the free allowance and your wallet balance run out, the paid feature pauses. We never charge more than your balance.
• Payments are handled by Razorpay (India) and Stripe (international). Their own terms also apply.
• We may change prices. A new price applies only from your next payment or use, never to money already paid.
• Refunds are covered by our Refund Policy.

7.Business websites and your customers

• If you run a business website on Shukto, you are the seller to your customers. You are responsible for your offers, prices, delivery, refunds, taxes and the claims you make.
• You must have a lawful reason to collect your visitors’ details and must tell them how you use them, for example in your own privacy notice.
• We may remove a site or offer that breaks these terms or the law.

8.What you must not do

• Break the law, or help anyone else do so.
• Create or share content that is harmful to children, hateful, harassing, sexually explicit, violent, or about weapons or attacks.
• Mislead people, impersonate someone, run scams, or collect other people’s passwords or payment details.
• Try to get around the Genies’ safety checks, hack, overload or copy the Service, or use it to send spam.
• Upload content you don’t have the right to use.

9.Your content and ours

• You own the content you add, and the website text and other output a Genie creates for you. You give us permission to store and process it only to run the Service for you.
• The Service itself, including our software, design, templates, Genie instructions and brand, belongs to us. You may use templates to build your own site on Shukto, but not resell them.

10.Suspension and closing accounts

We may suspend or close an account that breaks these terms, harms others or puts the Service at risk. Where we can, we will warn you first and explain why. If we close your account without a serious breach on your part, we will refund any unused wallet balance.

11.Our responsibility to you

We work hard to keep the Service running and accurate, but we provide it “as is”. We can’t promise it will always be available or error-free.

As far as the law allows, we are not responsible for indirect losses such as lost profits, lost business or lost data. Our total responsibility to you for any claim is limited to what you paid us in the 12 months before the claim.

Nothing in these terms limits rights you have under the Consumer Protection Act, 2019 or any other law that can’t be excluded.

12.Governing law and disputes

These terms are governed by the laws of India. Please contact us first so we can try to sort things out. If we can’t, the courts in Kolkata, West Bengal have jurisdiction.

13.Changes to these terms

We may update these terms. We will change the date at the top, and tell you in advance about important changes. If you keep using the Service after a change applies, the new terms apply.
